if it is now illegal to gamble online within the US why do these gambeling sites still take your money. My little brother stole 1000 dollars from me and lost it all on a poker site. Is there anyway to get my money back should I contact the fed government about this site? how would you handle this?
one yes online poker for money is illegal in the united states. I can get the statuit number if you would like.
2 I tried signing up for the same site aqbout a month ago and they would not take my debit card due to the fact I was a resident of the United States.
3 I had given him a check for his birthday that he photo copied and was using the reference and accounting number to gain acces to the funds in my account.
4 Although he is a pain in the ass I would rather not see him go to jail.

richard it is not illegal to buy food but it is illegal to gamblle with money online no matter what country the compnay is based out of. The user of the computer and the financial institution are based in America. If a muslim cAME OVER HERE AND KILLED HIS DAUGHTER AS AN HONER KILLING WHICH IS NOT ILLEGAL IN THERE COUNTRY HE WOULD STILL BE PROSECUTED HERE. SAME AS WITH THE CEOS OF THESE ONLINE GAMBLING SITES ONE FOOT IN aMERICAN TERITORY AND THEY ARE IN JAIL.
But guys it is not like he had a check from another country it is an american based bank. So if there are laws passed not allowing the transfer of funds from an american bank to a gambeling site how do they get around that. I am still miffed I went on last night and tried again still no go says financial inst based in the US. So if it is illegal for these sites to withdrawl the money how do they get around it.

well, most probably the poker site is not based in the US, so our rules don’t apply to them. I’m sorry to say you probably lost that money. Have your little brother be your slave for 10 years

In most states it’s not actually illegal to play, but financial institutions can get in trouble for cooperating with online gambling companies.
Since the online poker site is foreign there is nothing you can really do about it. America is already violating international trade agreements by enacting a semi-ban on online poker. So they are not going to rock the boat further by pursuing a perfectly legal company that operates overseas in accordance with the law of their land.
My question is how you put yourself in a position to have $1,000 stolen from you. If he took it out of a bank account fraudulently, then you should report the theft to the bank in question and explain that you did not authorize the transaction. If you had the money in cash, that’s an expensive lesson on why you don’t keep that kind of money lying around.

first of all online poker is not illegal in the united states. Youve been ill imformed. second of all do you mean to tell me that if your little brother went out and bought a bunch of food for a big party and your money was gone , that you would go to the supermarket to try and shut them down? of course not they did nothing wrong your brother is the theif and you allready know this. You are jumping the gun on this you have every right to be peeved at your brother but he should be the one to pay you back.

yes it is illegal but there is ways around it
most of these sights are off shore companies and some are in Canada
and the US can not prosecute them..
60 minutes exposed cheaters a couple weeks ago on that show and explained what was going on.mainly cheating
some places take an all access visa or master card to secure their account as a way around the laws

it’s illegal for companies based in the US to accept credit card transactions for online poker.
it is not illegal for an individual to play.
there are plenty of sites based overseas that are not breaking the law, and you are not breaking the law if you play. you just can’t deposit money from here.
google the poker player alliance.

No, except for a few states. The bill which recently passed addressed deposit methods and financial institutions (banks) that allow gambling transactions, not the players. A US DOJ official said in a Congressional hearing it was not illegal for US players to play online. The new law makes it illegal for US banks to allow gambling related transactions so the actual legality of online poker has not changed. There has been much debate over this issue for years but to this date no one has been arrested for playing poker online. Although, it is clear that online sports betting is definitely a federal crime nobody has been arrested for playing online poker. Please see state bans above for more details and possible felonies.

Sorry to break it to you, but online poker is not illegal in the US. It is illegal for a bank to process a credit card gaming transaction, but the legit sites use third party companies to process e-Check payments. I used to work for such a company and they are 100% legit, and I spoke to people just like yourself on an almost daily basis.
The only way to get the money back is to file a police report for the theft and take a copy of the police report to a) your bank, and send copies to b) the processing company who should have a fraud department.
You will have to bring charges against your brother though, but it is the only way he’ll learn.

E-Checks are open to fraud very easily. I was always of the opinion that they should be either banned, or have an extra level of security built in that only the account holder would know.
If you got a check from anyone, all you need to do is copy the routing number and account number from the bottom of the check and there are a lot more things you can do than just gamble online.
Which poker site was it? If it was PokerStars their processing company is based in Australia and they are the good guys and will help you out as best they can within the constraints of their business.
These companies get around the anti gaming legislation by paying the gaming sites on behalf of the customer who then pays the third party instead.

Online poker is NOT illegal in the US – bank transfers of funds to poker sites are. That’s why online sites don’t take credit or debit transfers from US players any more. Now online poker IS illegal (albeit almost impossible to enforce) in some states like Washington, but it just isn’t so everywhere in the US. Don’t blame the online sites just because you have a crook for a brother…sounds more like a job for your local police than the Feds.

Well I wouldn’t be impressed if you quoted the statutes although if you were a lawyer you would know that these things are far from cut and dried plus you could probably spell it correctly as well
A lot of folks will tell you it isn’t illegal and what’s being outlawed is certain transactions. Other people will tell you it’s illegal everywhere in the U.S. It’s not quite as simple as either of these. First of all it’s a matter of jurisdiction and online stuff is funny that way in terms of even defining where the event took place. States have jurisdiction in the areas of gambling and for a time the feds believed that it came under such things as the wire act meaning that they had jurisdiction but as time has passed here it’s generally now believed to be a state issue. Since then a few states have passed legislation and others have contemplated it specifically prohibiting online gambling although at this time no one is enforcing it and given the cost and difficulties of doing so it’s not on the horizon either.
Now in terms of your brother, the poker room involved, by allowing U.S. players, does not give a hoot here and in no sense are they subject to U.S. laws even if there are any here, and that’s even a matter of debate and jurisdiction. It’s possible you could dispute this with the payment processor if they were out of line in processing it but my guess is that he knew what he was doing and used one of several legal ways to fund the account.
Which brings us to the rather humorous point of your saying it’s illegal and all that and then saying you tried to deposit but couldn’t. Maybe you can ask your brother how he did it

Look the bottom line is your brother stole your identity…
It is very easy to make a deposit using a checking account…all you need is the checking account and routing number, social security number and a password…that is it!!! I know this is fact because this is how I make my deposits…
You want to find fault in the online poker room but in reality it is only your brother who really did the illegal act of stealing your identity…for you to get that $1,000 back you will need to sue your brother and is that really gonna happen?!?
